§ 2-24. Vacancies in office.

  • (a)

    What constitutes vacancy.

    (1)

    Vacancy shall occur upon the death or mental illness resulting in mental incompetency of the mayor or any member of the city council.

    (2)

    Vacancy shall occur upon the absence from three consecutive regular monthly meetings of the city council of the mayor or any member of the city council. Attendance of these officials is required.

    (3)

    Vacancy shall occur upon the removal of his place of residence from within the city limits on the part of the mayor or any member of the city council.

    (b)

    Effective date of vacancy; effect of resignation on voting. A vacancy shall be deemed to exist for the purpose of the city council's filling the vacancy, from the date of the tender of a resignation. The individual who has tendered the resignation shall continue to vote on all matters, including but not limited to the appointment of the individual who shall fill the vacancy, until a replacement has been sworn in.

    (c)

    Recommendation of replacement; vote; term. When a vacancy occurs in the office of mayor or city council, the vacancy shall be filled by a member of the present council recommending a qualified voter in the city to fill the vacancy. The vacancy shall be filled only by a majority vote of the city council. Any individual filling a vacancy shall serve for the remainder of the unexpired term for which he was appointed.
