§ 4-3. Definitions.

  • The following definitions shall apply throughout this article.

    Animal control officer shall be a duly appointed agent of the City of Freeport, Florida and shall be authorized to execute the provisions of this article.

    Animal control shelter shall mean any premises designated by the action of the city council for the purpose of impounding and caring for all animals found in violation of this article.

    Nuisance shall mean:

    (1)

    Any animal which molests passersby or passing vehicles;

    (2)

    Any animal which attacks other animals;

    (3)

    Any animal which trespasses on school grounds or public places;

    (4)

    Any animal which damages private or public property;

    (5)

    Any animal which scatters garbage or trash;

    (6)

    Any animal which is repeatedly at large;

    (7)

    Any animal which causes or emits unreasonable or offensive odor which can be detected off the premises of the owner or keeper;

    (8)

    Any female animal in heat not properly restrained; and

    (9)

    Any place where an animal is kept in such a manner as to cause a breeding place for flies, lice, fleas, or other vermin, or a breeding place for any disease.

    Owner shall mean any person, persons, firms or corporations owning, harboring, or keeping for more than ten (10) days any animal, domestic household pet, or otherwise, unless such person, persons, firms, or corporations merely has temporary custody of the animal and such custody is expressly authorized by the legal owner.

    Restraint exists when any animal is:

    (1)

    Secured by a leash or lead;

    (2)

    Under the control of a responsible person and is obedient to that person's commands within the real property limits of the owner; or

    (3)

    Within a structure or a fenced enclosure within the real property limits of the owner.

    Vicious animal shall mean any animal that constitutes a physical threat to humans or other animals.
