§ 4-6. Impoundment.

  • (a)

    Any vicious animal not confined within a suitable fence enclosure shall be impounded.

    (b)

    Any animal off owner's property not displaying proper identification shall be impounded.

    (c)

    Any nuisance animal as defined in this article shall be impounded.

    (d)

    Any impounded animal shall be held for three days. If not claimed within three days, the animal control officer shall cause such animal to be disposed of.

    (e)

    If by identification collar, tag, or other means the owner of an impounded animal can be identified, the animal control officer shall immediately notify the owner by telephone or by mail.

    (f)

    All animal control officers shall have the authority to pick up, impound, or otherwise confine any animal in violation of this article.

    (g)

    No person shall willfully refuse to surrender an animal upon lawful demand by an animal control officer or interfere with, hinder, or molest such officer or other authorized agent in the performance of any duty of such officer or agent, or seek to release any animal in custody of such officer or agent except as herein provided.

    (h)

    The animal control officer shall notify in writing the owner of any place that is in violation of [nuisance provisions as defined in section 4-3] and give the owner ten days to cure said violation. Failure to cure said violation shall result in the animal control officer impounding the animal(s) as provided for under other provisions of this article.
